To apply for this visa, you must be outside Australia when you submit your application and also when the visa is granted. This means you need to be offshore, not in Australia.

Benefits of the 115 Visa:

  • As a holder of the Remaining Relative visa (subclass 115), you can enjoy these privileges:
  • Live in Australia as a permanent resident.
  • Apply for Australian citizenship once you meet the criteria.
  • Freely leave and return to Australia for five years from the date the visa is granted. After five years, you will need to apply for another visa to return to Australia.

Eligibility Criteria:

You can apply for this visa if:

  • Your close relatives, including your partner’s close relatives, are Australian citizens, Australian permanent residents, or eligible New Zealand citizens.
  • An eligible close relative or their spouse (who must be at least 18 years old) is willing to sponsor you and all family members.
  • You have someone willing to provide an assurance of support, which is a legal agreement to offer financial assistance.
  • You and your dependent family members meet the health and character requirements.

You Will Not Be Considered Eligible For This Visa If:

  • Your or your partner’s close relatives are in Australia unlawfully, hold bridging visas, or any temporary visas.
  • Your sponsor or their partner was a holder of Remaining Relative visa (subclass 835 or 115), Preferential Family visa (subclass 104), or Family Visa (subclass 806), or had sponsored someone on these visas.

Who Are Eligible Close Relatives?

  • A close relative living in Australia must be one of the following:
  • Your parent or your partner’s parent (biological or step-parent).
  • Sibling (brother or sister).
  • Step-sibling (step-brother or step-sister).
  • Child or stepchild who is 18 years of age or older and not dependent.
  • Child or stepchild under 18 years of age who is not under your or your partner’s daily care and control.

Health and Character Requirements:

You and the dependent family members in the visa application must:

  • Undergo a medical examination and meet the minimum requirements to pass the medical exam.
  • Obtain police clearance from each country where you and your family members have lived for more than 12 months in the past ten years. This is only required for adult applicants who are 18 years or older.

Debts To The Australian Government:

You must clear any outstanding debts to the Australian Government before the visa is granted.

In your visa application, you can include the following family members:

  • Your partner.
  • Your or your partner’s child or stepchild.
